Terms of purchase — Elio Evan

1. Scope and acceptance
These terms govern the use of the Site and every purchase made through it. Browsing and placing an order imply full acceptance of them. They are addressed to natural persons acting as consumers; purchases for wholesale or professional use require prior arrangement with the Company.
2. How to order
Through the Site. Select the pieces you want, add them to the basket, then complete and submit the order form. Before ordering, you are asked to read and accept these terms, so the conditions of each purchase are clear in advance.
By telephone. Orders can also be placed by calling +30 2310 250509, Monday to Friday 09:00–17:00 CET (excluding public holidays), by phone or video call. Once the pieces are chosen, the Company sends a confirmation with a payment link to complete the order.
3. Formation of the contract
The display of products is an invitation to order. The contract is formed only when the Company confirms acceptance of the order by a relevant message. Until then the Company reserves the right not to accept an order, in particular in the event of stock depletion or an obvious pricing error.
4. Products, prices and availability
The Company keeps the information on the Site as complete and accurate as possible, subject to occasional technical or typographical errors. Stock is kept up to date, though the volume of orders may sometimes cause changes. If a product appears at an unusually low or high price, please contact the Company before ordering. Prices shown are final and include VAT; they may change without notice, but the customer always pays the price agreed at the moment the order is finalised. Personal details entered for a transaction must be accurate and true.
5. Right of withdrawal and returns
A customer who is a consumer may withdraw from a distance sale within 14 calendar days of receiving the order, without giving any reason. Sending the withdrawal notice or the item itself within 14 days is enough to exercise the right in time.
The cost of return is borne by the customer and varies by destination — differing for returns within Greece and from any other country — as set out on the Shipping & Returns page. These amounts may change at any time without notice.
A return is accepted when the item is unworn and undamaged, with its tags and original packaging intact, and accompanied by the invoice or receipt. Only the handling necessary to establish the nature, characteristics and functioning of the product is permitted — as would be done in a shop. The Company is entitled to reduce the refund proportionately, or to refuse the return, where the product is returned worn, washed, altered, stained or scented (perfume/smoke), or without its tags, on account of the diminished value (Article 14(2) of Directive 2011/83/EU).
For hygiene reasons, underwear and socks cannot be returned once the seal has been opened. The refund to the original payment method is made after the product is received and checked. To start a return, write to info@elioevan.com.
The right of withdrawal does not apply to products made to the customer's specifications or clearly personalised, nor to sealed items that are not returnable for hygiene reasons once unsealed. To exercise the right you may optionally use the following model: “To Elio Evan — I hereby give notice that I withdraw from the contract of sale of the following: [products]. Ordered/received on: […]. Name and address: […]. Date: […].”
6. Statutory guarantee of conformity
Irrespective of the right of withdrawal, products are covered by the statutory guarantee of conformity. If a product shows a lack of conformity within two (2) years of delivery, the consumer is entitled to have it brought into conformity free of charge (repair or replacement) and, where the legal conditions are met, to a proportionate price reduction or to withdrawal, in accordance with Directive (EU) 2019/771 and applicable law. The guarantee does not cover normal wear or damage caused by misuse.
7. Authenticity and resale
The Company guarantees the authenticity and condition only of products purchased from the Site or from authorised partners. Products obtained through third parties or resale platforms (for example, second-hand listings) are outside the Company's responsibility, and the statutory guarantee of conformity as well as the right of withdrawal apply solely to the original consumer who dealt directly with the Company and do not transfer to subsequent buyers. The resale of genuine products is permitted by law; however, the Elio Evan marks, images or name may not be used in a way that suggests an official partnership, approval or authorised-reseller status. The Company reserves the right not to accept or to cancel orders intended for commercial resale.
8. Payment methods
Elio Evan accepts the local payment methods available in each country, together with Klarna. Where Klarna is offered, payment may be split or deferred according to Klarna’s terms, shown at checkout. Cash on delivery and bank transfer are not available. Every order is invoiced, so billing details should be entered correctly.
9. Shipping
Within the European Union, shipping is complimentary on orders over €300; below €300 the cost is calculated at checkout. For the rest of the world, shipping is calculated by delivery address at checkout. For destinations outside the EU, an estimate of duties and import taxes is shown at checkout; actual amounts may vary by country and are settled with the carrier on arrival. Order progress is shared by email and via the carrier’s tracking.
10. Force majeure
The Company aims to fulfil every order within the stated timeframes. Where events beyond its control (such as severe weather or strikes) make delivery within that time impossible, please contact the Company for an update.
11. Liability
The Company is liable in accordance with the law for damage caused by intent or gross negligence. It is not liable for interruptions or technical faults of the Site beyond its control. Nothing in these terms limits the consumer's mandatory statutory rights.
12. Intellectual property
The Elio Evan mark, the logos, texts, photographs and other content of the Site are protected by intellectual and industrial property rights and belong to the Company or its licensors. Their reproduction, distribution or commercial use without prior written permission is prohibited.
13. Data protection
The processing of the personal data you provide when ordering is governed by the Data Protection Policy (www.elioevan.com/en/data-protection-policy) and the Cookies Policy, in accordance with Regulation (EU) 2016/679 (GDPR).
14. Complaints and dispute resolution
For any complaint or dispute, please contact the Company first at info@elioevan.com so that an amicable solution can be sought. As a consumer you retain the right to alternative dispute resolution (ADR). In Greece the competent body is the Consumer Ombudsman, an independent authority, at no cost to the consumer. Consumers in other EU countries may turn to the European Consumer Centres (ECC-Net) or to the competent ADR bodies in their country.
15. Applicable law
Any dispute between a customer and the Company is governed by Greek law and subject to the exclusive jurisdiction of the Courts of Thessaloniki.
The above does not affect the mandatory protections afforded to the consumer by the law of their country of habitual residence.
16. Amendments to the terms
The Company may amend these terms at any time. The version in force at any given time is published on the Site, while each order is governed by the terms in force at the moment it is placed.
